DWI Penalties

New Jersey has varying penalties for each time a person is charged with and convicted of driving while intoxicated:

  • First Offense- An individual convicted of operating a vehicle with a blood alcohol content (BAC) between .08 and .10% may face penalties including fines ranging from $250 to $400, 12 to 48 hours in jail, and a three month suspension of their license. If the person’s blood alcohol content is over .10% or if they are under the influence of illegal drugs, the penalties may be increased to fines ranging from $300 to $500, 12 to 48 hours in jail, and a license suspension of seven months to a year.
  • Second Offense- A second conviction may result in fines ranging from $500 to $1,000, up to 30 days of community service, two to 90 days in jail, a two year suspension of their license, and the installation of an ignition interlock device.
  • Third Offense- Anyone convicted of DWI for a third time, or any offenses after the third, may face penalties such as $1,000 in fines, a minimum of 180 days in prison, a maximum of 90 days of community service, installation of an ignition interlock device, and license suspension for up to 10 years.
