What are the penalties for being convicted of possession of illegal drugs?
If you are convicted of illegal drug possession, the penalties you can face vary based on the amount and type of drug involved in the case. Also, the number of offenses you have committed in the past can influence the severity of the penalty as well. Generally speaking, a person’s first conviction for drug possession can leave him or her facing these consequences depending on the drug involved:
- Marijuana – up to 18 months in state prison if the offense is indictable. If tried in municipal court, the individual may face up to six months in county jail.
- Cocaine/Methamphetamine/Heroin – up to 5 years in state prison and $15,000 fine.
In addition to these penalties, you may also have your driver’s license suspended and could possibly have to surrender some of your personal property.
