Complications With Restraining Orders

In New Jersey, domestic violence itself is not technically considered a “criminal” offense, and a restraining order is not a criminal penalty. Domestic violence cases are first handled by the Family Court, unless the domestic abuse or spousal abuse is so severe as to warrant charges for assault — a clear violent crime.

In less severe situations, a restraining order is issued and the case remains in Family Court unless the defendant commits a violation of the restraining order, often by contacting the victim or by going too close to the victim’s home or place of employment.
