Although the penalties for many traffic offenses may be considered minimal, Driving While Suspended/Revoked is not included in that category. In fact, in New Jersey, a person convicted of this offense may face mandatory jail time as well as up to $2250.00 in fines and penalties.

Penalties
Penalties for Driving While Suspended/Revoked are set forth in N.J.S.A. 39:3-40 as follows:
- Upon conviction for a first offense, a fine of $500.00 and up to six (6) months loss of license;
- Upon conviction for a second offense, a fine of $750.00, imprisonment in the county jail for 1-5 days and up to six months loss of license;
- Upon conviction for a third or subsequent offense, a fine of $1000.00, imprisonment in the county jail for 10 days and up to a six month loss of license.
If you are previously suspended for a DWI or Refusal, there is a mandatory 1-2 year loss of license and 10-90 days in the county jail. If you are suspended and have an accident (even if it is not your fault) resulting in bodily injury, you face a mandatory 45-180 days in the county jail.
